LEGAL SITUATION

BRAZIL'S IGAMING MARKET

A lot of currently existing gambling and gaming activities have not yet been regulated in Brazil. However, recently several important and very positive legal developments did occur or are underway.

 

Sports betting and iGaming regulation at federal level:

In December 2018 a law permitting sports betting was published and after more than four years, the required regulation was approved in December 2023.

In the course of this political process, accompanied by a strong lobby, even iGaming have been made part of this new regulation. During 2024 the Brazilian Ministry of Finance's newly formed Secretariat of Prices and Betting have published a number of ordinances to fill in the remaining details and various publications will follow still during the upcoming months. Anyway, from 1st of January 2025 this part of the long awaited regulated Brazilian gaming market became reality.

Now, as important and longlasting political hurdles seem to be cleared, the process of another proposal about more gaming verticals is currently in discussion in the senate at an accelerated speed, including bingo (land-based), casino (resorts) and even Jogo de Bicho (street lottery).


Lottery regulation at state level (incl. a.o. sports betting):

In September 2020 the Federal Supreme Court of Brazil ruled that the federal government's lottery monopoly was unconstitutional, facilitating the possibillity of local lottery in all of Brazil's 27 states, and in theory in more than 5000 municipalities.

FEDERAL REGULATIONS

LICENSING

Since the end of 2018 a federal sports betting law has been on the books. The required detailed regulation has only been published at the end of 2023 and during 2024, and a few conditions are still needing further definition from the Ministry of Finance and other governmental bodies or agencies.

However, the regulation is already in effect from 1st of January 2025. The main financial conditions for an operator license are a.o. a fee of around EURO € 5.000.000 for a 5 year license to operate 3 brands, in combination with 12% tax on GGR (Gross Gaming Revenue).

In addition to these investments and tax expenses, there are high organizational, technical and further financial requirements to become a regulated operator in Brazil. On top of all this, a significant investment in marketing and management is needed. These federal licenses are therefore sought mainly by a mixture of international Tier 1 operators, and local operators that have already invested heavily over the past five years to achieve a significant market share.
 

By the end of February 2025 more than 70 companies, operating in total over 170 brands, were licensed. The expectation is that ultimately there will be over 100 federal licesees The majority of these licensees will need to invest further in the expansion and professionalism of their local organization, as well as improvement and localization of their product and content.

STATE LOTTERY

LICENSES

In September of 2020, Brazil's Supreme Court ruled that the federal government's lottery monopoly was unconstitutional, paving the way for lotteries in all of Brazil's 27 states (including the so-called Federal District) and in theory more than 5000 cities.

Brazil's lottery definition and regulation is quite broad, with opportunities for sports betting (fixed odds lottery) and several other types of lotteries such as: passive numerical lottery, numerical forecast lottery, specific forecast lottery, sports forecast lottery and instant lottery.


The bidding procedures and processes to obtain a state (or municipal) license, in comparison with a federal license, will logically be more influenced by local presence and good contacts The state lottery licensees will therefore generally be held by local and regional operators, usually in joint ventures with international partners to be able to meet all the necessary volume, experience and certificate requirements.


Most of the state licensees will have to invest in the improvement of their portfolio of products, services and organization to meet the above mentioned conditions, business opportunities and to be competitive in general.

Combined with the online offer, most of the state and municipality lottery licensees will have to create and manage local land-based structures, which will provide additional business opportunities, but also requires extra investment in hardware, software and structure.

While it is of course difficult to obtain reliable figures from an unregulated market, it is clear to anyone involved in the iGaming industry, that Brazil has enormous potential and that, once regulated, it will become one of the world's largest official gambling and betting markets.
